Florida Gun Control on Trial: What’s at Stake

Over the past few weeks, multiple lawsuits have been filed against Florida gun control laws. This might be the beginning of rolling back years of restrictions. 

Fortunately, Florida’s new Attorney General, James Uthmeier, has pledged not to defend laws in court that he believes are unconstitutional.

So far, he is keeping that promise by instructing his office not to defend the under-21 purchase ban before the Supreme Court.

Uthmeier even went so far as to petition the Court to hear the case and strike down the law as unconstitutional. 

This highlights the differing opinions among lower courts on the same issue, with some upholding the ban and others striking it down, making it ripe for Supreme Court review.

This is a breath of fresh air from former AG and now Senator Ashley Moody, whose office fought for years defending this gross violation of Second Amendment Rights. 

But this is only a start. We still need to see more from AG Uthmeier. There are two other lawsuits moving forward, and so far, his office has been quiet. 

One lawsuit in the Southern District of Florida challenges the state’s ban on open carry. It has been in the works since August 2024, before Uthmeier took office, and a motion for summary judgment was recently filed.

Florida Gun Rights appreciates the AG’s strong stance on the under-21 ban, but we are calling on his office to take a similarly strong stand on Open Carry.

The most recent lawsuit challenges Florida’s mandatory three-day waiting period. 

This suit takes a two-pronged approach: first, targeting the 1990 constitutional amendment imposing a three-day wait for handguns; and second, challenging the 2018 Parkland law that extended the waiting period to all firearms.

A federal court in New Mexico recently struck down that state’s seven-day waiting period as unconstitutional.

These three lawsuits could reshape Florida’s gun laws, but we cannot rely solely on the courts. Legislators in Tallahassee must also act to repeal these infringements.
